A federal judge ordered the Obama Administration to release a Syrian detainee from the Guantanamo Bay prison facility who had the misfortune of being mislabeled an enemy combatant by the U.S. even though he was likely nothing more than a victim of the Taliban.
As NPR's Ari Shapiro reported:
The detainee who goes by the name Janko is a 30 year old Syrian. American forces picked him up in Afghanistan.
They accused him of training with Al Qaeda and volunteering to be a suicide bomber.
The U-S admitted in court that Al Qaeda held Janko in an Afghan prison for almost two years.
The Taliban tortured him into falsely confessing that he was an American spy.
Janko was abandoned in a cell with thousands of other prisoners when the Taliban fled incoming American forces.
But the U-S government argued that Janko was nevertheless still an enemy combatant.
Judge Richard Leon has now ruled the government's position "defies common sense."
He told the government to take all diplomatic steps necessary to release Janko.
The detainee has been at Guantanamo for more than 7 years.
The Justice Department says it's reviewing the decision.
