Business Takes on HBO in Name Dispute

Fitness instructor Jennifer Cassetta wants to trademark the name of her business, "Health and the City." But the television cable company HBO argues the phrase sounds too much like the name of its hit series "Sex and the City."

Cassetta says she found out about the network's objection after she tried to trademark her company's name last year with the U.S. Patent and Trademark Office.

She says the idea for the name came to her while she was out for a run. It wasn't until later, she says, that she made the connection to the popular cable program.

Despite the similarity in names, Cassetta says her fitness and martial arts business has nothing to do with the show — a fact even HBO's lawyer agreed with.

Although HBO suggested Cassetta change the name of her business to "Health in the City," she refuses, saying it would cost her thousands of dollars to redo her marketing, brochures and Web site.

Instead, Cassetta plans to fight HBO — on her own. The young business owner says she cannot afford to hire an attorney.
